of our services constitutes acceptance of and agreement to our

Acceptable Use Policy (AUP)
We offer you, your
customers and website users the means to disseminate a
wealth of public, private, commercial and non-commercial
information. You are responsible for all
information placed on your website. Since your
postings to the Internet may affect our network and may
reach a large number of people, including both our
clients and non-clients, and may harm our goodwill,
business reputation and operations the following use of
our services is not allowed:

- Mass Download Music or Video
Files (ex: mp3 mass download sites, etc.)
- Intellectual Property
Violations
- Adult Material
- Defamatory, Abusive and/or
Harassing E-mails or Website Content

Spamming
Sending unsolicited bulk and/or
unsolicited commercial e-mail over the Internet (known
as "spamming") is strictly prohibited. It is not only harmful because of its
negative impact on consumer attitudes toward our
services but also because it can overload our network
and disrupt service to our clients. Also, maintaining an
open SMTP relay is prohibited. We strongly advise
against sending e-mail from an "opt-in" e-mail list
unless you are absolutely sure that the people on
the list did indeed "opt-in." We have the
sole discretion to determine from all of the evidence
whether the e-mail recipients were from an "opt-in"
e-mail list.

Warez, Shareware, Freeware,
Downloadable Software
You may not have a warez site or
a site that allows for distribution of shareware,
freeware, or downloadable software.
Downloads of Music or Video
Files
You may not post music or video
files for download that results in mass downloads.
For example, actor and director reels and
singer/songwriter demos are fine. Mass
downloadable mp3's or mp3 swap sites are not. If
you aren't certain if a file will be allowed, please
contact us prior to posting.
Intellectual Property
Violations
Engaging in any activity that
infringes or misappropriates the intellectual property
rights of others, including copyrights, trademarks,
service marks, trade secrets, software piracy, and
patents held by individuals, corporations, or other
entities. Also, engaging in activity that violates
privacy, publicity, or other personal rights of others.
Adult Material
- Any site whose revenue is
gained in part or whole from its adult content.
- Photos or videos showing
frontal nudity on either men or women for
non-scientific or non-artistic purposes.
- Content that is not
appropriate for users of all ages
- Revenue generating hyperlinks
to sites who violate policy #1.
We will be the sole arbiter of
what is considered "adult content", "adult material",
"sexually explicit", or "sexually related". Please
let us know if you are unsure of the approval of your
site before placing an order.
E-mails or Website Content
that is Defamatory,
Abusive and/or Harassing
You may not use our network as a
means to transmit or post defamatory, harassing,
abusive, and/or threatening content or language.
Forging of Headers
Forging or misrepresenting
message headers, whether in whole or in part, to mask
the originator of the message.
Illegal or Unauthorized
Access to Other Computers or Networks
Accessing illegally or without
authorization computers, accounts, or networks belonging
to another party, or attempting to penetrate security
measures of another individual's system (often known as
"hacking"). Also, any activity that might be used as a
precursor to an attempted system penetration (i.e. port
scan, stealth scan, or other information gathering
activity).
Background Running Programs
Background Daemons in general
are prohibited on KGI Enterprises' servers, including,
but not limited to, IRC bots, eggdrop, BitchX, XiRCON,
warez and any other program that interferes with normal
server operation.
Distribution of Internet
Viruses, Worms, Trojan Horses, or Other Destructive
Activities
Distributing information
regarding the creation of and sending Internet viruses,
worms, Trojan horses, pinging, flooding, mailbombing, or
denial of service attacks. Also, activities that disrupt
the use of or interfere with the ability of others to
effectively use the network or any connected network,
system, service, or equipment.
Facilitating a Violation of
this AUP
Advertising, transmitting, or
otherwise making available any software, program,
product, or service that is designed to violate this
AUP, including, but not limited to, the facilitation of
the means to spam, initiation of pinging, flooding,
mailbombing, denial of service attacks, and piracy of
software.
Export Control Violations
Exporting encryption software
over the Internet or otherwise, to points outside the
United States.
Usenet Groups
We reserve the right not to
accept postings from newsgroups where we have actual
knowledge that the content of the newsgroup violates the
AUP.
Other Illegal Activities
Engaging in activities that are
determined to be illegal, including, but not limited to,
advertising, transmitting, or otherwise making available
ponzi schemes, pyramid schemes, fraudulently charging
credit cards, and pirating software.
Other Activities
Engaging in activities, whether
lawful or unlawful, that we determine to be harmful to
our clients, operations, reputation, goodwill, or
customer relations.
Sole Arbiter
We will be the sole arbiter as
to what constitutes a violation to this policy.

As we have pointed out, the
responsibility for avoiding the harmful activities
described above rests primarily with you, the client.
We will not, as an ordinary practice, monitor your
communications to ensure that they comply with our
policy or applicable law. When we become aware of
harmful activities, however, we may take any action to
stop the harmful activity that we deem necessary,
including but not limited to, removing information,
shutting down a web site, implementing screening
software designed to block offending transmissions,
denying access to the Internet, or any other action we
deem appropriate. We may take this action without
prior notification to you.
We will not intentionally
monitor private electronic mail messages sent or
received by you unless we are required to do so by law,
governmental authority, or when public safety is at
stake. We may, however, monitor our service
electronically to determine that our facilities are
operating satisfactorily. We may disclose client
information or information transmitted over our network
where necessary to protect our network and/or others
from harm, where such disclosure is necessary to the
proper operation of the system or when required by a law
enforcement entity.
We may revise this AUP from time
to time. It is your responsibility to check our
website (websiteforme.com) for changes to our policies.
Your use of our services after changes to our AUP are
posted on our website will constitute your acceptance of
these changes.
